Terms of service

The agreement between you and Keydams (Andreas Adams, Nueva Colombia, Paraguay) for the use of ConformTrail. Two sections matter more than the rest: what a payment covers and how it ends (section 6), and the limits of an automated reading (section 5). Both are written to be read. This page states what we do; it is not legal advice.

1. Who these terms are between

These terms are between Keydams (Andreas Adams, Nueva Colombia, Paraguay), a sole proprietor established in Paraguay (“we”, “us”, the operator), and the firm whose public pages a report is about, or a person acting for that firm (“you”, the customer). ConformTrail is a business service; it is not offered to consumers. By ordering you confirm that you act for that firm and are entitled to bind it.

2. What the service is

ConformTrail reads the public pages of one website, records what was displayed on them with the page address, the date and a screenshot, and puts each observation next to the wording of the document the supervisor published, with that document’s own date and address. Where monitoring is part of what you bought, the same pages are read again on a schedule, you are told when a new pattern appears, and the page states of each scan date are kept as the record.

  • An observation is a fact with a place: what was displayed, on which page, in which element, on which date, with the screenshot that shows it. It is never a verdict about you or your firm.
  • Every rule reference is quoted in the words of the supervisory document it comes from, with the date we read it. We write no rule text of our own and we give no legal advice.
  • A report names the pages it read and the pages it did not, so the reader can see the edge of what was looked at.

3. Your firm and your public pages

  • You order for a website your firm operates, or you act for the firm that operates it, and you are responsible for that authority. A report is about one firm: yours. We take no order for the website of a third party and we hand nobody a report about you.
  • We read public pages only. We fetch robots.txt first and obey it, keep to one request per second per host, use GET only, and identify our crawler as ConformTrailBot/1.0 (+https://conformtrail.com/bot). We never log in, never submit a form and never upload anything.
  • Whatever sits behind a login, a paywall or a form stays unread, and so does whatever robots.txt keeps us out of. A page we could not reach is named as unread, not counted as clean.
  • You keep your sign-in link to yourself and tell us promptly if it is exposed.

4. Your report is yours

The report you paid for is yours: keep it, print it, store it, hand it on unchanged to your own people, to your adviser or to an examiner. You need no permission from us for that, and we ask for no share of what you do with it.

What stays ours is the software, the detectors, the report templates and our own name. The right to use a report is not a right to resell the service under a name of your own. Where you show our name, the line “ConformTrail — website compliance evidence and monitoring” stays with it.

5. No guarantee of compliance

We give no guarantee of compliance. ConformTrail reports what an automated reading of a public page can observe: what was displayed, where and when. Whether a statement on a page is adequate, complete or accurate is a judgement for the supervisor, and it is not something a detector can measure. Every report says what we read and what we did not.

  • We promise no outcome and no protection. Nothing we sell changes the state your pages are in, keeps anyone from asking a question about them, or stops a script from loading.
  • A clean report is evidence that the detectors we ran observed nothing on the pages we read on that date, not evidence that a site meets a legal standard.
  • What we produce is a record of observations. It is not legal advice, not an audit certificate, not an assessment by a qualified assessor and no defence in any proceeding. Rules, dates and deadlines shown on our pages and in our reports are given for orientation and must be checked against the current official text.
  • For payment page evidence (Module 2): this is evidence for your attestation and your assessor; it is not a substitute for a QSA assessment and does not block scripts.
  • We install no overlay, no widget and no script on your pages, and we block nothing that loads on them.

6. Payment, renewal and cancellation

Prices are in US dollars and are due in advance. The table below is the price list: the offer pages show the same figures, because both read them from the same file.

  • Who takes the payment. Card payments are processed by Lemon Squeezy as merchant of record: it is the seller for that transaction, issues the receipt, handles sales tax and VAT, and its own terms apply to the payment itself.
  • Refunds. Ask within 14 days of a payment and you get that payment back in full, without giving a reason. That holds for a one-off purchase even after the report was delivered and downloaded, and for the last payment of a subscription, a yearly payment included. After the 14 days there is no refund of that payment and no part refund of a period that is running. The refund policy says how to ask.
  • Cancelling a subscription. Cancel at any time in the customer portal of Lemon Squeezy — the link is in your receipt and in your account — or write to support@conformtrail.com. The period you paid for runs to its end and nothing is taken after it.
  • A one-off purchase is not a subscription. It sets up nothing that would charge you again, and there is nothing to cancel.
  • Price changes. We may change a price. For a running subscription we tell you by email before the change, and the new price applies from your next period; until then the price you ordered at stands.

7. Acceptable use

Do not use the service to have a website read that you have no right to have read, to put load on a third party, to resell raw access to the software as a platform of your own, or for any unlawful purpose. We may suspend an account that does, and we will say why.

8. Availability, liability and term

  • We aim to keep the service reachable and to run every scheduled scan, but we do not promise uninterrupted service. A scan can be delayed by a site being unreachable, by robots.txt, or by our own maintenance.
  • To the extent the law allows, our total liability in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for lost profit, lost business or indirect loss.
  • Nothing here limits liability that cannot be limited by law, including for our own intent or gross negligence.
  • Either side may end the agreement as described in section 6. After it ends, a report link keeps working for the rest of its lifetime and the data is deleted as set out in the privacy notice.

9. Changes and governing law

We may update these terms. A material change is announced by email before it takes effect, and use after that date means acceptance. This agreement is governed by the law of the Republic of Paraguay, where the operator is established, without prejudice to mandatory law that applies to you.

10. If the operator changes

We may transfer this agreement, with the account, the running subscriptions and the reports it covers, to a successor that carries the service on — for example when the business moves to another entity or another country. We tell you by email before such a transfer takes effect. Your subscription keeps its price and its period, your reports stay reachable, and these terms keep applying until they are changed under section 9. If you would rather not go on, cancel as described in section 6.
